MONROVIA Jan. 11 (LINA) – The Judge of the Monrovia City Court, Jumah Jallah, has denied the motion filed by lawyers representing Sidikie Bility, son of top businessman Musa Bility, to dismiss the crime of interference with child custody, theft of property, and criminal conspiracy levied against him.
Judge Jallah, at the same time, ordered that the children in question be produced during the next trial and ruled that the case be tried.
The motion was filed on grounds that the Court has no jurisdiction over the matter, adding that the Court also does not have any jurisdiction over the issues involved in the action.
They asserted that there are other actions pending between the same parties for the same cause in a court in the Republic of Liberia.
The motion filed by Sidikie Bility’s lawyers stated that the parties in the proceedings, Mr. Bility and his wife, are before the Civil Law Court in an action of divorce along with an action for custody of his minor children while both Mr. Bility and his wife are currently on separation.
The motion further stated that the statute provides in Section 11:2 of the Civil Procedure Law, which is applicable to the criminal procedure grounds to dismiss an action which states as follows: “time grounds at the time of service of responsive pleading, a party may move for judgment dismissing one or more claims for relief as asserted against him in a complaint or counter claim on any of the following grounds.”
But Judge Jallah denied said motion on grounds that it does not matter whether the case is pending before a court, therefore the children should be brought immediately during the next trial and that the case is being ruled to trial.
The Temple of Justice ground was a place of attraction during the hearing of the case on Monday, where the wife of Sidikie Bility, Madam Warti R. Bility, was accompanied by some groups of women who came in her defense.
They held placards emblazoned with inscriptions calling for justice in her favor.
The women convened at the Temple of Justice grounds for about four hours with their placards, one of which read: “We need justice for Warti Bility,” while another read: “Sidikie Bility bring back the children.”
It can be recalled that in November 2020, the Monrovia City Court issued a writ of arrest against Sidikie Bility for the crime of interference with child custody, theft of property and criminal conspiracy.
The writ of arrest stated: “You are hereby commanded to arrest the living body of Aaron C. Korboi, Mamie Sango and Sidikie Bility to be identified defendants and forthwith bring them before the Monrovia City Court to answer to the charges levied against them. »
The writ stated that the defendants mentioned did with criminal intent conspire purposely take possession of her two minors in persons of Al’ Hussein Bility (eight years old) and Sidikie Bility (five years old) without the consent of their mother.
The couple has been married for five years now and in a divorce proceeding in court.
The case continues pending notice of assignment.
